Over the last three days, conversations surrounding former President Barack Obama's potential arrest for conspiring to subvert Donald Trump's 2016 election victory have returned to social media, particularly due to recent posts being shared by Trump supporters. Several MAGA supporters have promoted posts accusing Obama of colluding with Russia in an attempt to manipulate the 2016 elections. However, the claims reflect wishful thinking that does not borrow from any recent developments or is backed by evidence.

The rumors surrounding Obama's arrest began last July after Director of National Intelligence Tulsi Gabbard publicly accused the former President and several of his top administration officials of orchestrating a "treasonous conspiracy" to undermine Trump's 2016 victory. "There is irrefutable evidence that details how President Obama and his national security team directed the creation of an intelligence community assessment that they knew was false," Gabbard said at a press conference after declassifying a set of documents related to the January 2017 Intelligence Community Assessment (ICA) and the origins of the Russia investigation.
However, when asked if she believed that Obama was guilty of treason, Gabbard evaded a direct answer and instead said that it was for the Department of Justice to decide. "I am not an attorney, but as I've said previously, when you look at the intent behind creating a fake, manufactured intelligence document that directly contradicts multiple assessments... the expressed intent and what followed afterward can only be described as a years-long coup and a treasonous conspiracy against the American people, our republic, and an attempt to undermine President Trump's administration," she said.
Soon after Gabbard's referral, Attorney General Pam Bondi announced that the DOJ was creating a "strike force" to assess the evidence, and in August, last year, directed federal prosecutors to launch a grand jury investigation into the accusations. But despite the referral of nearly 200 pages of documents, no charges have been filed against Obama or any of his officials. As per reports from early 2026, the DOJ reviews found insufficient grounds for prosecution. Legal issues such as statutes of limitations are additional barriers to an immediate criminal prosecution, The Sunday Guardian reported. Obama's office has consistently dismissed the allegations as "bizarre and ridiculous" and an "attempt at distraction." The former president's office also said that the documents released by Gabbard do not undercut the "widely accepted conclusion that Russia worked to influence the 2016 presidential election but did not successfully manipulate any votes."
